The European Union high court has ruled member governments
can temporarily ban genetically modified foods if they suspect
they threaten health or the environment. The ruling was made
in a case which pitted biotech giant Monsanto against the Italian
government. The ruling is expected to mark yet another setback
for biotech companies trying to sell their genetically modified
products in Europe. The Court said Italy was entitled to ban
foodstuffs - notably flour made from genetically modified maize
- by Monsanto Europe and two other companies. The judges however
cautioned that Italy must still provide detailed evidence of
the products' suspected risks to sustain any ban. A European
nation "can as a preventive measure ... temporarily restrict
or suspend the marketing of those foods in its territory,"
the Luxembourg based court said . There should be no "relaxation
of the safety requirements that must be met by novel foods.”
